What is The Muslim Will and why should I use it?
The Muslim Will is an online platform designed to help Muslims in North America create legally valid and Shariah-compliant wills quickly and securely. It ensures your estate is distributed according to Islamic inheritance rules while meeting local legal requirements. Unlike generic will services, we integrate Islamic law (Faraid) with Canadian and U.S. legal standards.
Who can use The Muslim Will?
Any Muslim adult living in Canada or the United States can use our platform. Whether you are single, married, or have dependents, The Muslim Will simplifies the process for all family structures.
Is this service available outside North America?
Currently, The Muslim Will is optimised for Canada and the U.S. We plan to expand globally soon. If you live elsewhere, you can still use the platform for guidance, but legal compliance may differ.
Do I need to be a practising Muslim to use the platform?
No. Our service is open to anyone who wishes to follow Islamic inheritance principles. Even if you are not practising, you can still create a will that respects Shariah.
Can non-Muslims use the service for regular wills?
Yes. While our primary focus is Islamic wills, non-Muslims can use the platform to create a standard legal will. However, Islamic inheritance calculations will not apply.
Legal Compliance
How do you ensure the will is legally valid in Canada and the U.S.?
We use region-specific templates verified by legal professionals. Each will includes instructions for signing, witnessing, and notarisation to meet provincial/state laws.
Do I need a lawyer to finalise my will?
No lawyer is required for a basic will. However, if your estate is complex, we recommend consulting a lawyer. We can connect you with partner legal advisors.
What happens if my province/state has different requirements?
Our system automatically adjusts your will based on your location. For example, Ontario requires two witnesses, while some U.S. states allow notarisation instead.
Does the will include instructions for witnesses and notarisation?
Yes. Your final document comes with clear steps for signing, witnessing, and optional notarisation.
Can the will be contested in court?
Any will can be contested, but ours is designed to minimise disputes by following legal and Islamic guidelines.
Shariah Compliance
Which Islamic schools of thought do you follow?
We support all four major Sunni madhabs (Hanafi, Shafi’i, Maliki, Hanbali). Our inheritance engine applies universal Faraid principles.
How do you calculate shares for heirs?
The system uses Qur’anic inheritance rules to allocate fixed shares to heirs such as spouse, children, and parents.
Can I change the fixed shares for my heirs?
No. Islamic law does not allow altering fixed shares. However, you can allocate up to one-third of your estate for charity or non-heirs.
What is the one-third rule in Islamic inheritance?
You may bequeath up to 33% of your estate to non-heirs or charities. The remaining two-thirds must go to fixed heirs.
Can I exclude an heir from my will?
No. Islamic law prohibits disinheriting fixed heirs. However, you can make charitable bequests within the one-third limit.
How do you handle debts and funeral expenses?
Debts and funeral costs are settled first, before distributing inheritance. Our system includes these steps in your will.
Can I include a waqf (endowment) in my will?
Yes. You can allocate part of your one-third bequest to establish a waqf.
Does the system support multiple madhabs?
Yes. You can select your preferred madhab during setup.
